Known as the Consumer Sales Practices Act, this set of statutes and rules allow consumers to seek refunds or triple damages and reimbursement for attorney fees under certain circumstances. Most consumer transactions are subject to the Consumer Sales Practices Act but specific rules apply to car repairs, car sales and home improvements. An act or practice is “unfair” if it is marked by injustice, partiality or deception, or it results in inequitable business dealings. A business may commit an “unconscionable” act or practice when it manipulates the consumer’s understanding of the nature of the transaction.
Be advised that the Consumer Sales Practices Act is only enforceable for two years after the transaction occurs.
